    I am not sure if there is a way for you or your attorney to verify. You should ask your attorney and if it is possible, please verify.

    I got stuck in Canada for a week because the PIMS was not up-to-date. Luckily it took only a week but I have heard stories people getting stuck for a couple of weeks. If you are not in the PIMS, the consulate contacts the KCC and they have to research and update the PIMS. Do a find on PIMS and you'll hear a lot of stories.

    Anybody Travelled with only Advance Payrole through Frankfurt recently please post ?

    where they will check for transit visa in usa while boarding or in frankfurt or in india while return ?

    My nationality is Indian. Presently i am residing in USA . I have " Advance Payrole Document " . I am planning to travel in this February 2011 from " Atlanta -> Frankfurt -> India(Hyderabad) " and return is in May 2011 from " India(Hyderabad) -> Frankfurt -> Atlanta " in lufthansa airways.

    So shall i go for this round trip with a valid " Advance Payrole Document " only ? or i need to have " Air Transit Visa ? If i need Air transit Visa could you please let me know how to apply and what documents i need to submit .

    While pending i-485 if i applied for German airport transit visa is there any negative concerns because of that ?

    I think you there should not be problem as you have new job offer...

    One thing I could not understand , why have they called for interview ? I know few people in similar situation got their GC mailed to them.

    Have you informed USCIS about AC-21 after leaving petitioner epmloyer ?

    went for infopass for correcting wife's DOB. Officer said it cannot be corrected here. After some protest, he took photocopies of birth certificate and passport and then sent e-mail to service center. Also, enquired about her EAD which is now pending for 110 days. Officer was not able to say why it is pending. just have to wait.

    My wife went for her biometrics today and what a surprise, her date of birth on the system was wrong.
    She only had DL on her and no passport. So, the ASC staff took her biometrics but refused to correct her DOB, claiming that passport was needed.
    So, we called up USCIS and upon description of the problem,were immediately transferred to level 2. Level 2 looked at the cases and confirmed that DOB was wrong on I-485. It was correct in I-765 and I-131. She said that the only way to correct it was to take infopass and present passport and DL.

    It is now more or less clear that DOB mismatch has caused her EAD to be stalled for so long.I have already got my EAD.

    Moral of the story : take passport for FP, infopass, etc. all the time.

    Our EADs and APs were filed separately with I-485 courier receipt. What a mess !!

    lets see what happens at infopass.

    Somebody needs to look at the issue of mismatch between increased H1-Bs and visa numbers for greencards. Otherwise the current green card backlog for some EB countries will only widen leading to untold suffering for people from many countries. Maybe they should have a new visa similar to H1 but which does not allow the holder to apply for a green card. The better solution is of course recapture of visa numbers. Simply increasing the H1-B quota will be quite detrimental.

    I strongly disagree with previous comment. CA is though certification, it has course work which can be claimed as Masters degree (or advanced degree). I am a CA but even have Master degree got GC under EB2. But I know atleast one more person who is CA but without Master degree got GC under EB2. You need to get education evaluation done such a way that you qualify as done course work equivalent to Master degree. Good Luck

    I am courious why you want to qualify for EB2, EB3 has later date than EB2.

    By now perhaps the orginal poster is travelling to India. He can return to US on an unexpired H-1 visa with new H-1B documents. But it is difficult to get a H-4 stamp unless the new H-1 petition is approved.

    it doesn't boil down to who you trust more. Both opinions have its merits.

    But you should base your decision on whether or not you have truly ported to a job with similar duties and if you have the paperwork to prove it. If you have all this, then evn if you do get RFE its not a bad thing, since you can prove that you did no wrong.

    Just my 2 cents.

    My EB-3 labor PD is 02/2007, my I-140 is stuck-up in NSC for more than one year now.

    Considering the present trend, I decided to move on to EB-2. I pressurized my employer to file for another PERM for EB-2 which they are now reluctantly doing. Let me see what happens :rolleyes:

    Congrats and great job. However, I disagree with the salary part you
    mentioned in your interview. You had mentioned that the salary used to
    be 1/10 or even 1/20 of the US salary when you moved back to India. Do you
    think this is correct ? I dont think that is a correct ratio

    At times, unconsciously, we exagerate how bad it is in India while it is not.


    Just my 2 cents. Again, this is not to find fault. Great job.
